IXL Learning's Exceptions: 1) Add the following: IXL’s terms of service and privacy policy apply to the IXL Service provided by IXL. Such terms and policies in effect as of the date of the District’s order shall apply to the extent not inconsistent with the terms set forth in this RFP (as modified by any exceptions submitted by IXL). The terms of service and privacy policy are posted on the following web pages: IXL Learning Terms of Service: https://www.ixl.com/termsofservice IXL Learning Privacy Policy: https://www.ixl.com/privacypolicy 2) Criminal Background Check and Identification Badge – Add the following: "Per Texas Education Code 22.0834, background checks are only required when (1) the employee or applicant has or will have continuing duties related to the contracted services; and (2) the employee or applicant has or will have direct contact with students. IXL’s quote is based on the understanding that its employees will not have direct contact with students and thus no background checks are required. To the extent that the District believes that direct contact with students will be required, IXL invites further discussion so as to adjust the scope of any professional services to avoid direct contact. To the extent that the District intends to require background checks beyond the requirements of TEC 22.0834, IXL will require further clarification as to the scope and requirements of such background checks before it can determine whether it can agree to expanded background checks." 3) Please note the following: “IXL’s entire submission is exempt from disclosure pursuant to Texas Gov’t Code § 552.104 because the information, if released would give advantage to a competitor. See, e.g., Texas Attorney General Opinion OR2018-12944 (opining that IXL RFP submission not subject to disclosure per 552.104).
